Disciplinary Action

If you are found to be in violation of the Alcohol and Other Drug Policy, you will be held accountable for your actions and you will be held accountable for allowing or encouraging violations by your guests. The institution has a two-part response system for students in violation of the Alcohol and Other Drug Policy: a disciplinary response and an educational response. The procedures for the resolution of disciplinary actions are outlined in the Conduct section of the Student Handbook. You are expected to participate in both the disciplinary and the educational process, including meetings with university officials and presence at review meetings and hearings. You will be given sufficient advance notice, in writing, of scheduled meetings and hearings. If you fail to attend a disciplinary meeting or hearing, decisions will be made without your input and you will not be granted an appeal of that decision.

Disciplinary Responses to AOD Violations

The following sanctions (see table) will be imposed at a minimum for alcohol or other drug violations.

In the case of Tier 2 violations, the university reserves the right to impose more severe sanctions (e.g. university suspension) for a first or second violation when warranted by the danger or illegality of the incident. At a minimum, Tier 2 violations will result in probation.

** Residence Probation is a designated period of time in which a student is given the opportunity to modify unacceptable behavior. Any additional violations of the Alcohol and Other Drug Policy (Tier 1 or Tier 2) or any Tier 2 violations of the Conduct policy during the probationary period will result in a referral for residence suspension (persona non grata status for the commuter student).

Student Assistance Program (SAP)

SAP is designed to provide a service to students whose personal problems, in particular substance abuse, are adversely affecting job or academic performance. You may access SAP in one of two ways:

Self-Referral/Employer Referral:

You may self-refer to SAP or may be referred by an employer due to performance issues at work. If you self-refer or are referred by an employer to SAP, any on-campus assessment services are confidential and free of charge. Any services provided beyond the campus may involve costs to you, but in some cases these costs are discounted or covered by medical insurance.

Policy Violations:

The SAP Committee meets regularly to review student violations of the university's Alcohol and Other Drug Policy. Reviews by the committee are conducted to identify behavioral patterns that pose a health or safety risk to the individual or the campus community. Activities of the SAP Committee are educational in nature and complement the disciplinary sanctions imposed by the university. If you are referred by a university official after an Alcohol or Other Drug Policy violation or as a result of an academic or behavioral concern, SAP members may be required to share information with other university officials.

Educational Responses to AOD Violations

(no parental notification)

Once a violation has been adjudicated in the disciplinary process, a violation form is forwarded to the SAP Coordinator. The SAP Coordinator reviews the violation and meets with the SAP Committee to determine what educational activity will be utilized. All students generally receive the educational activities outlined in the first column of this table (see column heading, Alcohol Rules). Additional or different measures are imposed when the incident involves a Tier 2 violation (see column headings for Alcohol Abuse and Controlled Substances and/or Paraphernalia).

In addition, the student will be reassigned to the program and charged again.
