Policy on Sexual Misconduct

Southern New Hampshire University is committed to preventing sexual misconduct and to providing prompt and professional counseling services to all members of its community. The institution does not tolerate sexual assault in any form.

Sexual misconduct that involve penetration or sexual contact that results in serious psychological and/or physical injury are felonies under New Hampshire law.

Harassment and any conduct that threatens to endanger the health or safety of any person on university property are also prohibited by the University’s Code of Conduct and the Unified University Handbook for Faculty, Professional Staff and Operational Staff. Anyone who violates the law and the institution’s rules is subject to stringent penalties.

Where there is reasonable cause to believe that a member of the university community has violated regulations prohibiting sexual misconduct, the university may reprimand, suspend or expel that person. Disciplinary action will be taken whether the conduct occurs on or off the campus. If you are involved in a sexual assault, you will find confidential crisis intervention and counseling services through the Wellness Center. The counseling staff is available regardless of any decisions you may make to pursue the matter legally.

If you are the survivor of an assault and wish to report it and to have the matter prosecuted, the Office of Public Safety will assist you in bringing the case before a court of law. All instances reported to the Office of Public Safety will be reported to local authorities. You may also submit a complaint through the university disciplinary system, in addition to or in place of, criminal prosecution or civil action.

As members of the university community, we are all responsible for creating a safe and wholesome environment. You should be aware of both the consequences of sexual misconduct and the options available to survivors. If you are the survivor of sexual misconduct, then you should seek assistance using any of the available campus resources.
